Welcome to The Lifestyle Blueprint. These Terms and Conditions ("Terms") govern your access to and use of our website, services, coaching programs, and any related content provided by Dave Kennedy ("we," "us," or "our"). By accessing or using our website and services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our services.

1. ACCEPTANCE OF TERMS

By registering for our programs, booking a consultation, subscribing to our email list, or otherwise engaging with our services, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting on our website. Your continued use of our services after such changes constitutes your acceptance of the revised Terms.

2. ELIGIBILITY

To use our services, you must: (a) Be at least 18 years of age or the age of majority in your jurisdiction; (b) Have the legal capacity to enter into a binding agreement; (c) Provide accurate and complete information when registering or booking services; (d) Not be prohibited from using our services under applicable laws. If you are using our services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

3. SERVICES PROVIDED

3.1 Overview - The Lifestyle Blueprint provides online fitness coaching, nutrition guidance, mindset coaching, and lifestyle transformation programs specifically designed for farmers and individuals in rural communities. Our services may include: one-on-one coaching sessions, group coaching programs, personalized fitness and nutrition plans, access to educational content, videos, and resources, community support through private groups or forums, and email support and check-ins.

3.2 Service Delivery - Services are delivered primarily through digital channels, including email, video calls, messaging platforms, and our online portal. We reserve the right to modify or discontinue any aspect of our services at any time, with or without notice.

3.3 No Guarantee of Results - IMPORTANT: While we are committed to providing high-quality coaching and support, individual results may vary. We do not guarantee specific outcomes, weight loss results, or health improvements. Your success depends on various factors, including your commitment, adherence to the program, individual circumstances, and other factors beyond our control.

4. MEDICAL DISCLAIMER

PLEASE READ CAREFULLY: The Lifestyle Blueprint is a fitness and lifestyle coaching service. We are NOT medical professionals, and our services do NOT constitute medical advice, diagnosis, or treatment. By using our services, you acknowledge and agree that: (a) You should consult with a qualified healthcare provider before starting any fitness or nutrition program, especially if you have pre-existing health conditions, injuries, or concerns; (b) You are solely responsible for determining whether our programs are appropriate for your individual health and fitness level; (c) We are not liable for any injuries, health complications, or adverse effects that may result from your participation in our programs; (d) You will immediately discontinue any exercise or dietary practice if you experience pain, discomfort, or any adverse symptoms, and seek medical attention as needed; (e) Any nutrition advice provided is for general informational purposes and is not a substitute for professional dietary or medical guidance. If you have any medical conditions, including but not limited to heart disease, diabetes, high blood pressure, musculoskeletal injuries, or are pregnant or nursing, you MUST obtain clearance from your doctor before participating in our programs.

5. USER RESPONSIBILITIES

As a user of our services, you agree to:

5.1 Provide Accurate Information - Provide truthful, accurate, and complete information when registering for our services, booking consultations, or communicating with our team. You must promptly update any information that changes.

5.2 Follow Program Guidelines - Follow the coaching guidelines and recommendations provided to the best of your ability. While we understand that life circumstances may interfere with adherence, consistent effort is essential for achieving results.

5.3 Communicate Openly - Communicate openly and honestly with your coach about your progress, challenges, and any issues that arise during the program.

5.4 Respect Community Guidelines - If you participate in our community groups or forums, you agree to: treat other members and coaches with respect and courtesy, refrain from posting offensive, abusive, or inappropriate content, protect the privacy of other members by not sharing their personal information, and not engage in spamming, solicitation, or promotional activities without our permission. We reserve the right to remove any user who violates these guidelines or engages in disruptive behavior.

5.5 Account Security - You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately if you suspect any unauthorized use of your account.

6. PAYMENT TERMS

6.1 Fees and Pricing - The fees for our services are specified at the time of purchase or enrollment. All prices are in the currency displayed and are subject to change without notice. Any price changes will not affect existing agreements.

6.2 Payment Methods - We accept payment via credit card, debit card, PayPal, or other payment methods as indicated during checkout. Payment processing is handled securely through third-party payment processors.

6.3 Payment Authorization - By providing your payment information, you authorize us to charge the applicable fees to your chosen payment method. For recurring subscriptions, you authorize us to charge your payment method on a recurring basis until you cancel.

6.4 Recurring Billing - If you enroll in a subscription-based program (e.g., monthly coaching), your payment method will be automatically charged at the beginning of each billing cycle. You can cancel your subscription at any time by contacting us or through your account settings, subject to our refund policy.

6.5 Late or Failed Payments - If a payment fails or is declined, we reserve the right to suspend your access to services until payment is received. You are responsible for any fees charged by your financial institution for failed payments.

6.6 Taxes - All fees are exclusive of applicable taxes (including VAT, GST, or sales tax), which will be added to your invoice as required by law. You are responsible for paying all applicable taxes.

7. REFUND AND CANCELLATION POLICY

7.1 Refund Eligibility - We stand behind the quality of our services. However, due to the personalized and digital nature of our coaching programs, refunds are handled on a case-by-case basis. 30-Day Money-Back Guarantee (Where Applicable): For certain programs, we offer a 30-day money-back guarantee. If you are not satisfied with your purchase within the first 30 days, you may request a full refund by contacting us at [email protected]. To qualify for a refund under this guarantee, you must: (a) Demonstrate that you have made a genuine effort to follow the program (e.g., attended scheduled coaching calls, completed assigned tasks); (b) Provide constructive feedback about why the program did not meet your expectations. This guarantee does NOT apply if you have violated these Terms, engaged in fraudulent activity, or abused the refund policy.

7.2 Non-Refundable Services - The following are generally non-refundable: one-time consultations or brainstorm sessions that have already been completed, services consumed or accessed after the refund eligibility period, and downloadable materials or digital products that have been accessed or downloaded.

7.3 Cancellation of Recurring Subscriptions - You may cancel your subscription at any time by contacting us or through your account settings. Cancellations will take effect at the end of the current billing cycle. No refunds will be provided for partial billing periods unless otherwise stated.

7.4 Refund Process - Approved refunds will be processed within 7-14 business days and credited to the original payment method used for the purchase.

8. INTELLECTUAL PROPERTY RIGHTS

8.1 Ownership - All content, materials, and resources provided through our services, including but not limited to text, graphics, videos, logos, software, and coaching materials ("Content"), are the intellectual property of Dave Kennedy and The Lifestyle Blueprint or our licensors. This Content is protected by copyright, trademark, and other intellectual property laws.

8.2 Limited License - We grant you a limited, non-exclusive, non-transferable, revocable license to access and use our Content solely for your personal, non-commercial use in connection with our services. You may not: reproduce, distribute, modify, or create derivative works from our Content without our written permission; use our Content for commercial purposes or on behalf of any third party; remove or alter any copyright, trademark, or other proprietary notices; share login credentials or access to our programs with others; or record, screenshot, or distribute coaching sessions or proprietary materials.

8.3 User-Generated Content - If you submit content to us (e.g., testimonials, photos, feedback), you grant us a perpetual, worldwide, royalty-free license to use, reproduce, modify, and display such content for marketing, promotional, and educational purposes. You represent that you have the right to grant this license and that your content does not violate any third-party rights.

9. TESTIMONIALS AND RESULTS

Testimonials and success stories featured on our website and marketing materials represent the individual experiences of specific clients and are not guarantees of results. These examples are provided for illustrative purposes only. Individual results will vary based on factors including, but not limited to, starting point, adherence to the program, individual metabolism, lifestyle, and genetics. We do not guarantee that you will achieve similar results.

10. PRIVACY AND DATA PROTECTION

Your use of our services is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using our services, you consent to the practices described in our Privacy Policy.

In no event shall our total liability to you for all claims arising from or related to our services exceed the amount you paid to us in the 12 months preceding the claim. 14. DISCLAIMERS

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to: warranties of merchantability, fitness for a particular purpose, or non-infringement; guarantees that our services will be uninterrupted, error-free, or secure; guarantees that any defects will be corrected; or guarantees regarding the accuracy, reliability, or completeness of any Content. You acknowledge that you use our services at your own risk.

15. TERMINATION

15.1 Termination by You - You may cancel your account or subscription at any time by contacting us at [email protected]. Cancellation will take effect as described in Section 7.

15.2 Termination by Us - We reserve the right to suspend or terminate your access to our services at any time, with or without notice, if: you violate these Terms or engage in fraudulent, abusive, or illegal activity; you fail to make payment for services; we discontinue our services or cease operations; or as required by law or regulatory authorities.

15.3 Effect of Termination - Upon termination, your right to access and use our services will immediately cease. Sections of these Terms that by their nature should survive termination (including, but not limited to, intellectual property rights, disclaimers, indemnification, and limitation of liability) will continue to apply.

16. DISPUTE RESOLUTION AND ARBITRATION

16.1 Informal Resolution - If you have a dispute with us, we encourage you to first contact us at [email protected] to attempt to resolve the matter informally.

16.2 Binding Arbitration - If we are unable to resolve the dispute informally, you agree that any claim or dispute arising from or relating to these Terms or our services will be resolved through binding arbitration, rather than in court, except where prohibited by law. Arbitration will be conducted by a neutral arbitrator in accordance with the rules of a recognized arbitration body (e.g., the Dubai International Arbitration Centre or an equivalent organization). The arbitration will take place in Dubai, UAE, or remotely via video conference if agreed upon.

16.3 Class Action Waiver - You agree that any arbitration or legal proceeding will be conducted on an individual basis and not as a class action, consolidated action, or representative action. You waive your right to participate in a class action lawsuit or class-wide arbitration.

16.4 Exceptions - Either party may seek injunctive relief or other equitable remedies in court to protect intellectual property rights or confidential information.

17. GOVERNING LAW AND JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates, without regard to its conflict of law provisions. To the extent arbitration does not apply, you agree that any legal action or proceeding arising from these Terms shall be brought exclusively in the courts of Dubai, UAE, and you consent to the jurisdiction of such courts.

18. SEVERABILITY

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it enforceable.

19. WAIVER

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorized representative of The Lifestyle Blueprint.

20. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy and any additional agreements you enter into with us, constitute the entire agreement between you and The Lifestyle Blueprint regarding our services and supersede all prior or contemporaneous communications, whether written or oral.

21. ASSIGNMENT

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations without restriction.

22. FORCE MAJEURE

We shall not be liable for any failure or delay in performing our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, pandemics, or interruptions in internet or telecommunications services.
